Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website fatnotmuscle.com (the “Site”) operated by Fat Not Muscle / FatNotMuscle (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site. Last updated: April 2026.

1. Educational content only; not medical advice

The Site provides health and fitness information for general educational purposes only. Nothing on the Site is medical advice, diagnosis, treatment, or a substitute for professional care from a licensed physician or other qualified healthcare provider.

Consult your healthcare provider before making any decisions about medications (including GLP-1 therapies), diet, exercise, supplements, or any change to your health regimen. Never disregard professional medical advice or delay seeking it because of something you read on the Site.

2. No doctor–patient relationship

Use of the Site does not create a doctor–patient, therapist–client, or other professional relationship between you and Fat Not Muscle or any contributor.

3. Eligibility and acceptable use

You agree to use the Site only in compliance with applicable law and these Terms. You will not:

  • Attempt to gain unauthorized access to the Site, systems, or data;
  • Use the Site to distribute malware, spam, or unlawful content;
  • Scrape, harvest, or automate access in a way that burdens or disrupts the Site; or
  • Misrepresent your identity or affiliation.

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Site or other users.

If you submit feedback, quiz responses, or other materials to us, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process those materials to operate and improve the Site, subject to our Privacy Policy. You represent that your submissions do not violate third-party rights or applicable law.

The Site may link to third-party websites, providers, or tools. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

7. Disclaimers

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information will be accurate or complete.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FAT NOT MUSCLE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US ANY FEES.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless Fat Not Muscle and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Subject to applicable mandatory consumer protections in your jurisdiction, you agree that exclusive jurisdiction and venue for any dispute arising out of these Terms or the Site shall lie in the state and federal courts located in Delaware, and you waive any objection to such jurisdiction or venue.

11. Changes to these Terms

We may modify these Terms at any time by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Site.

12. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fat Not Muscle regarding the Site and supersede prior agreements on the subject.
